Land, Real Estate & Conveyancing Law: Kamuri Gachoki & Co-Advocates, Kangema

Why land matters so much in Kangema and Murang'a

For most families in Kangema and across Murang'a County, land is the largest asset they will ever own. It is farmland passed down through generations, a plot bought in a growing town centre, or a commercial building built over many years of savings. Because the value is high and the paperwork is easy to get wrong, a mistake in a land transaction can cost a family far more than the legal fees that would have prevented it. Our land, real estate and conveyancing advocates help buyers, sellers, landlords, tenants, developers and lenders complete property transactions safely and resolve disputes when they arise.

Kenyan land law is governed mainly by the Constitution, the Land Act, the Land Registration Act and the Land Control Act, together with county planning rules and the practice of the land registries. Disputes over ownership, boundaries and use are heard by the Environment and Land Court. Knowing which law applies to your plot, and which office or court has the power to act, is half the battle, and it is where an experienced advocate saves you time.

Buying property: check first, pay later

The single most important rule in conveyancing is to investigate before you commit any money. Before a deposit is paid, we carry out due diligence on the property. That means obtaining an official search from the land registry to confirm the registered owner, the type of title and whether any charge, caveat, caution or court order is registered against it. It also means confirming that the seller is who they say they are and has the authority to sell, checking rates and land rent payments, and verifying the physical location and boundaries against the survey records.

Where the land is agricultural, consent of the relevant Land Control Board is generally required for a sale, transfer or lease, and a transaction completed without it can be void. We make sure that step is not missed. We then draft or review the sale agreement so that the price, payment schedule, completion date and the seller's obligations are clear and fair, and we manage the transfer, stamp duty and registration so that the title ends up in your name and not merely promised to you.

Selling, leasing, subdividing and financing

Sellers need good advice too. We prepare the agreement, deal with the buyer's advocates, handle the consents and discharge of any existing charge, and make sure you are paid in the manner agreed before the title is released. For landlords and tenants we draft and review lease agreements that deal plainly with rent, review of rent, repairs, use of the premises, renewal and termination, so that a small disagreement does not become a long dispute.

Many families also need to subdivide land for children or for sale, and this requires approvals from the county planning authority, survey work and registration of the new parcels. Where a bank or other lender is involved, we act on the registration of charges and the documents that secure a loan, and we advise borrowers on what they are signing and what happens if repayments fall behind.

When a land dispute arises

Land disputes in Kenya often come from unclear boundaries, double allocation, fraudulent transfers, family disagreements over inherited land, and unpaid purchase prices. The earlier you seek advice, the more options you have. Some matters can be settled through negotiation or mediation, which is faster and keeps relationships intact. Others need an urgent application to the Environment and Land Court, for example to stop a sale or a construction while the question of ownership is determined. Our advocates are trained mediators as well as litigators, so we can recommend the route that suits your goals and your budget.

If you are thinking of buying, selling or developing property, or if someone is claiming your land, call or message us on WhatsApp before you sign or pay.
