Employment & Labour Law: Kamuri Gachoki & Co-Advocates, Kangema

Fair work relationships protect both sides

Every workplace depends on clear expectations and fair treatment. Whether you run a small shop in Kangema, manage a growing company or work as an employee, the law sets out rights and duties that apply from the day you are hired to the day you leave. Our employment and labour advocates act for both employers and employees, which means we understand how a dispute looks from each side and can give honest advice about the strength of your position.

Employment in Kenya is governed mainly by the Constitution, the Employment Act, the Labour Relations Act, the Work Injury Benefits Act and related statutes on occupational safety and statutory deductions. Disputes are heard by the Employment and Labour Relations Court and, in some cases, resolved earlier through conciliation or mediation.

Support for employers

The best way for an employer to avoid a claim is to put the right documents and processes in place from the start. We draft and review employment contracts that match the role, set out pay, hours, leave, probation and notice, and comply with the Employment Act. We prepare staff handbooks and workplace policies, including disciplinary, grievance, anti-harassment and confidentiality policies, so that managers know how to act and employees know what is expected.

When a problem arises, the process followed matters as much as the reason. Under Kenyan law a termination must be for a valid reason and carried out fairly, which usually means informing the employee of the allegation, giving them a chance to respond with a representative present, and following the correct notice or payment. We guide employers through disciplinary hearings, performance management and redundancy, including the notices and terminal dues that the law requires, so that a lawful decision is not undone by a procedural error.

Support for employees

If you have lost your job, been suspended, not been paid, or been treated unfairly at work, you may have remedies. Common claims include unfair or wrongful termination, unpaid salary or overtime, unpaid leave, failure to pay terminal dues, discrimination, harassment and unsafe working conditions. We review your contract, your termination letter and the events that led up to it, explain whether the employer followed a fair process, and advise on the compensation or other relief you may be entitled to.

Time matters in employment claims, because the law sets limits on how long you have to bring a case. If you have been dismissed or are facing a disciplinary process, speak to an advocate quickly. We can often settle the matter by negotiation or conciliation, and where that fails we will present your case before the court.

A practical, mediation-minded approach

Many workplace disagreements are best resolved without a long court case. Our advocates are Certified Professional Mediators and Conciliators, and we use those skills to reach settlements that are fair, quick and confidential, particularly where the parties still need to work together or share a community. Where a dispute cannot be settled, we prepare and argue the case thoroughly.

To get started, bring your contract, any letters from the employer, your payslips and a short note of what happened and when. Call or send us a WhatsApp message and we will tell you honestly what your options are.
