Frequently asked questions
When should I involve an advocate in a legal matter?
You do not have to wait until a dispute reaches court. An advocate can help you understand your legal position, review documents, negotiate on your behalf, prepare agreements, or advise you on the best course of action before a dispute escalates.
Can I resolve my dispute without going to court?
Yes. Many disputes in Kenya can be resolved through negotiation, mediation, arbitration, or other forms of Alternative Dispute Resolution (ADR). Where appropriate, we help clients pursue a practical settlement while protecting their legal interests. Court proceedings may be considered when an amicable resolution is not suitable or successful.
How much does it cost to hire an advocate in Kenya?
Legal fees depend on the nature, complexity, and value of the matter, as well as the work required. Advocates' fees may be guided by the applicable Advocates Remuneration Order. We discuss the expected costs with clients at the beginning of an engagement so that they can make informed decisions.
Can an advocate help me with a land or property transaction?
Yes. An advocate can assist with land searches, sale and purchase agreements, transfers, leases, charges, due diligence, succession-related property matters, and other conveyancing transactions. Legal review before signing property documents can help identify potential risks and protect your interests.
What should I do if I have received court papers or been sued?
Do not ignore them. Court documents often contain strict deadlines for responding. Contact an advocate as soon as possible and provide all documents you have received. We can assess the claim, explain your options and advise on the appropriate response.
Can I get legal advice before signing a contract or agreement?
Yes, and it is often advisable to do so. An advocate can review the terms, identify unfavourable clauses, explain your obligations and negotiate amendments where necessary. Getting advice before signing is usually far easier than trying to correct a problematic agreement afterward.
Do I have to physically visit your offices to get legal assistance?
Not necessarily. Depending on the nature of the matter, initial consultations, document reviews and follow-up discussions may be handled through phone calls, email or online meetings. However, certain matters may require physical attendance, execution of documents, identification or other formal procedures.
